| Im not too versed on copyright vs trademark. Can someone elaborate?
Is it just the version/images that were used in their superpowers series that is trademarked?
Can I still use Black Terror or Arrow in a book in the pd version or update/change them as long as its not taking off of anything new that Dynamite added?

In terms of copyright, yes, you hit the nail on the head. Just don't use any elements that are unique to the Dynamite version of the characters.
Trademark covers product names and logos. If you make a Black Terror book called, The Black Terror,the general public may think Dynamite created it. So don't use that name on the cover or in your ads. The character can be called The Black Terror inside the comic, just not on the cover. Definitely don't use the Dynamite logo for Black Terror.
On the subject of Green Lama...it turns out the original pulp stories that the character appeared in, before his PD comic appearances was renewed. That means his visual interpretation in the comics may be public domain, but the character Jethro Dumont is not. So, I would avoid using him. If Project Superpowers continues, I don't think you'll be seeing him..... | |
